Unfortunately, divorce is a fact of life and the one thing that goes hand-in-hand with a marriage break-up is a divorce lawyer. This is not so much for the complexities of the filing and paperwork that will need to be done, but more so from the aspect of protecting yourself. You are also likely to have many questions about possible outcomes and how they will affect you and a good divorce lawyer can answer those questions and put you in a much more advantageous position in the divorce proceedings.

The last thing anyone getting divorced wants is for there to be any animosity but unfortunately it rarely happens and in particular when the couple has accrued large sums of money and other assets. These can be very trying times and many people have thought they could handle the divorce proceedings without representation but this invariably turns out to be a mistake, whereas a divorce lawyer will not become emotionally involved.

We all know that some state divorce laws are stranger and tougher than others so make sure your divorce lawyer is aware of local divorce laws before you hire them. Another excellent reason to have yourself represented by a good divorce lawyer is that there may be support involved otherwise known as alimony.

To most people the word alimony brings fear into the proceedings as it is support for the spouse and different for child support that is arranged separately as it is an amount calculated on the earning ability and standard of living both partners have as part of their marriage. While most instances of alimony are for set periods of time, this is not always the case and some people are faced with the knowledge that they may never finish paying it.

Although this can be an awkward situation if either partner experiences changes in their financial lives then it possible for the alimony situation to be looked at again. The situation with alimony is not open ended as far as claiming for it is concerned so when a spouse decides they do not require alimony but at a later time change their minds, it will not be granted.

Of course a divorce lawyer is also there to help protect the pension rights of the spouse he represents as these can be vulnerable in a divorce case. These too are treated as property belonging to both partners and are often divided between them as part of the divorce settlement.

Although the court system will attempt to be fair in the division of money and assets, especially with pension and retirement accounts, a good divorce attorney will fight for your rights and make sure as much as possible is done to your benefit. Your divorce attorneys fees will no doubt be high but what he can save in losses in just the matter of your pension will more than make up for this.
