Opting for a lawyer can be very expensive and seeming as we are in need of motoring advice regularly we tend to opt for the internet. The internet then provides us with the first level of information, if it then indicates we should take a lawyers opinion then we do. Dangers Of Negligent Driving

Where driving without due care and attention used to be something of a defence, it is now far more of an offence. Momentary lapses of concentration are no longer an excuse in a court of law, in fact, in some instances; it can be enough to land you in jail.

Organisations such as MADD (Mothers Against Drunk Driving) have been lobbying for this change in the law for a long time and now different parts of the country have varying levels of punishments for the offences depending on the severity of the results of the careless driving.

But what is so surprising is that people dont take driving without due care and attention so seriously. They sympathize with the offender and offer advice as to how they can get away from it all! On a legal forum, we came across a question put by a member who apparently was charged for spinning tires on a gravel road by virtue of going very fast. There was a petrol pump next to where he was fined and the officer mentioned in his report that the offender was driving without due care and attention, and that since the petrol pump was open and there were people in the area, he could have injured someone. Now, the question in the forum was whether proving if the petrol pump was closed will be beneficial to his case, and to our surprise, dozens of people gave advice as to how he could prove that something in the cops report was wrong! What citizenship!!

How To Make A Special Reasons Argument

If you have been unfortunate enough to be accused of committing a motoring offence , then you will need to prepare yourself quickly in order to put forward a plausible defence. There are many aspects of the law that are open to interpretation and the prosecutor needs to correctly complete every stage of the accusation process or you could have grounds to contest the allegation.

If you believe that the particular circumstances under which you committed the driving offence should exempt you from some or all of the punishment, then you can make a Special Reasons argument. These are most commonly used to avoid bans in drink driving cases, however they are sometimes used to avoid penalty points for other offences as well or driving through a red light.

When you argue Special Reasons, you have to give evidence under oath in order to persuade the Magistrates that in the circumstances, it would not be fair to put any points on your licence. The most common ground put forward is that the offence was committed in the context of an emergency, for example if you were rushing somebody to casualty and you went through a red traffic light or exceeded the speed limit.

Unless you are very familiar with the intricacies of motoring law you will either plead guilty or try to fight your case if you feel that you have been unjustly prosecuted. It is very important that you seek advice as the law is very specific on the terms of each and every prosecution. If all of the correct procedures have not been fulfilled then your case may even be thrown out of court.

Road Law

Road laws are the rules and regulations that all users of the road are required to follow. Though these laws do apply to all road users, they are of particular relevance to motorists and cyclists.

These rules are in place to govern the actions taken by drivers towards other other drivers and pedestrians. The basic road laws are written in an international agreement by authority of the UN.

There are different local variations of these laws to be found throughout the UN and on top of these, there are some unspoken rules that road users are universally aware of.

Whether you drive or not, we are all considered road users, whether we are drivers, cyclists, horse rider or pedestrians. The Highway Code is generally seen by everyone as the set of guidelines and laws that determine the correct way to behave on a road.

Back in 1930 there were only around two million motor cars on the roads, and in that year alone there were well over 7000 deaths by road accidents. Which is really, a staggeringly high number of deaths, considering there were well over 20 million motor vehicles on the road in 2004 and only around 3000 deaths.

The government of the 30′s obviously wanted to do something about this, so the Highway Code was created. This original version was 24 pages long and contained advice about driving a horse and carriage. So you can see, the Code has had many changes made to it over the years.

The History Of The Highway Code

The Highway Code is widely known by many as the set of laws and guidelines that govern the way we all use the roads, whether you are a pedestrian, a driver, a cyclist, a horse rider, or any other kind of road-user.

Around a decade the motorcar was born, there were two million of them on the roads and in 1930 there were around 7300 deaths by road accidents. Considering that in 2006 there were around 3000 deaths by road accidents and over 20 million cars on the road, the 1930 statistics needed sorting out.

The government of the day knew that they needed to do something about this, thus the Highway Code was born. Now nearly 80 years old, it has had a lot of changes made to it over the years considering that the original version of the Code contained information about things like what actions to take when driving your carriage and horses, and was only 24 pages long!
