The Experience: Platte County Attorney

Becoming a Platte County Attorney is the beginning of a new way of life. The many functions that are the responsibility of the County Attorney, leaves little time for extracurricular participation. Dedication is the driving force that commits the County Attorney in achievement of the primary goal of overseeing criminal justice.

The many criminal cases awaiting prosecution by this office are timely in completion, and are only a drop in the bucket in realizing the workload that this office has. Crimes committed can be slight or severe. With like punishment administered. There are infraction crimes with warnings issued, to misdemeanors and felonies. Misdemeanors can be cleared from a record, whereas for felonies removal may be either impossible or a long drawn out process.

The County Attorneys job is not an easy one and is very time consuming. He is not only responsible for the prosecution of crimes, but is the County Coroner too. Deaths that need investigation are his primary responsibility. He must trust and rely heavily on his departmental staff in working as a team in maintenance of all the divisions associated with his office.

New changes has recently made to the way the city of Birmingham handles cases of domestic violence and there are great hopes that this fresh approach will reduce such instances in the city.

There has been a ‘multi-agency’ approach present within the city for many years now, and it had worked to some extent, yet the governmental forces within Birmingham have decided that something else needs to be done in order to effectively combat domestic violence.

Moving away from this ‘multi-agency’ approach, the council have decided to work in a ‘partnership’ format, with several choice partners within the voluntary, commercial and legal statutory sectors, including divorce lawyers and practitioners.

There are many benefits to choosing to take a bicycle on your travels around London rather than any other means of transport; they are much faster than walking, more reliable than public transport, (unless you get a puncture!) and cheaper and more eco-friendly than taking a car. However, there are certain dangers that one faces when cycling around Britain’s capital city, so it is up to you to weigh up the various pros and cons of cycling around London.

Personal injury lawyer Stuart Kightley, of Osbournes solicitors in Camden, London has asked the question ‘is cycling in London good for your health?’ and attacks the query with some interesting numbers. As well as great legal advice, it seems that certain personal injury solicitors have a vested interest in their clients’ health and well being.

If an accident occurred then it used to be the case that the general consensus was just to grin and bear it, chalking it up to one of life’s mishaps. Not so anymore, claims many armchair commentators who claim that we now have a vast amount of the population cashing in on the ‘no win no fee’ offers that many internet and high street law firms are promising their potential clients and that we now live in a state of dependency and a culture of welfare. An insight is offered by Liverpool personal injury lawyer Jeffrey Logan, who is a partner at Liverpool law firm Goodmans.

Many lawyers dispute the claim that the introduction of ‘no win no fee’ claims leads to more frivolous cases and claims, and a general increase in cases on the whole, as they claim that lawyers act as a a filter to make sure that cases that don’t have any hope of winning do not make it to court.

Logan states that he personally ensures that Liverpool’s Goodmans law firm does not take on cases that do not have at least a 60% chance of winning; otherwise there would be too much of a financial risk to the company. Logan adds that solicitors now have a vested interest in reducing the amount of expensive delays that such cases can induce.

On the 20th of February 2009 the nation’s largest personal injury law firm has opened a new branch in Manchester city centre, in response to the amount of personal injury claims in the North West rising. Its key management team of Geraldine Coombs, Stephanie Forman and Andrew Tucker with will all be working round the clock in order to establish and maintain Irwin Mitchell’s sterling reputation in its Manchester office.

Coombs and Forman both specialise in personal injury and clinical negligence, with Coombs an industry heavyweight in asbestos related diseases and serious injury cases, while Forman focusing on birth injury, neonatal death, cancer, claims against the MOD and oncology; more background information on these partners is provided by Irwin and Mitchell’s website.

Both of these partners have had impressive results in successful the cases that their careers have seen them take on. For example, Coombs has been heavily involved in many landmark asbestos disease cases, with the inclusion of Lubbe/Afrika and others vs. Cape PLC, an infamous case that established South African miners’ right to sue for compensation in this country; the result of this case was a 10.5 million pay out back in March 2003.

At such times of financial and employment unrest, to lose one’s job can be a difficult experience to deal with; this is why some companies offer their redundant employees a package or pay off to help them on their way to finding a new job. The employers may wish them all the best for the future and the bonus is a thank you for the good work that they have put in over the year, so this is perfectly understandable, as the employees may be parting ways on good terms.

However, even the most generous of redundancy packages can not be enough to fill the emotional damage done by an improper dismissal; if the correct procedures are not followed then the employee can feel unappreciated, and their confidence shattered. This was the case when a Coventry cafe decided to get rid of a catering manager without following the proper procedures and left the manager without a job or a decent enough reference required for her to apply for another position at the same level.

The catering manager, who had worked in the cafe for over four years was dismissed from her position without prior warning or consultation, despite her hard work in the establishment and running of the business. She went straight to a Coventry employment solicitor to seek legal advice on what her best options were and was advised to sue her previous employers for not only unfair dismissal but the unfair deduction of wages and holiday pay.

We are taught not to discriminate against other people because of their heritage, race or colour of their skin from a young age. Why is it that professional adults cannot abide by the same law as most children, who understand that it is wrong to single out and pick on another person simply because they are of a different background to them?

A Bradford solicitor has been successful in a landmark case in racial discrimination, which involved her being suspended from working at her law firm due to the fact that she joked that she was ‘Osama Bin Laden’s friend’ because of her Muslim heritage. The comment was obviously made in jest; she even asserted that she was completely against the 9/11 bombings, yet the situation still led to her being suspended from her place of work.

A Bradford employment tribunal declared that there was, ‘not a shred of evidence’ to support the treatment of the solicitor, and demanded for her to be reinstated and issued a full and unequivocal apology. Funnily enough, the Bradford lawyer said that she would have been happy with a simple apology at the time and to let the whole thing blow over, yet it led to her hiring a Bradford employment solicitor and embarking on a seven year legal battle that cost the taxpayer 500,000 in additional costs.

In school, when one child told the teacher about some wrongdoing they were labelled a ‘grass’ or a ‘snitch’ by their classmates; juvenile, cruel and a little ridiculous, but then we can always excuse such behaviour in children. The same behaviour is, however, inexcusable in adults, especially when it is directed at someone as a direct result of their bravery in standing up for a just cause.

This was the case in a recent Wakefield prison tribunal, when a prison officer offered evidence at a disciplinary hearing against a former colleague and subsequently became the target of much abuse for the violation of a secret ‘code’ that apparently the officers all work and live by.

After she gave evidence at the tribunal, she began to receive despicable treatment at the hands of her fellow workers, including a wreath being sent to her house, grass cuttings being sent to her by mail and she even saw her young son spat on by a colleague.

One of the most common reasons why a marriage can end is that one partner has committed adultery; if one partner within a marriage ‘cheats’ on their other half, then the marriage is quite often headed straight to the court room.

Now, while the cheating partner usually claims that there are some special circumstances that can somehow justify or explain away their infidelity, no matter how compassionate and impassioned this plea may be, it is rarely the case as a judge sees it.

There is almost no excuse for cheating, and if you feel as if you would like legal advice on the legal state of your marriage after your partner has committed adultery then you should seek legal advice by contacting a Wakefield divorce lawyer today.
