I cannot believe the number of divorces in our courts. More and more people decide to throw in the towel in their relationship.

It’s tough to say whether or not more individuals wish to get divorced or whether it’s simply more acceptable. It’s a moot point, the point is divorce is commonplace.

One result is there are a lot more family attorneys. That said, more and more spouses also choose not to hire an attorney.

Lawyers aren’t always necessary and in some cases aren’t good because of the cost. If couples can work it out themselves, that is excellent.

1. The couple tries to come to some form of arrangement and agreement on all issues on their own. If this works, it is an excellent result.

If you stave of litigation disaster at this stage, that is an excellent result. Wrapping it up is simply a matter of the paperwork. Be sure to get the terms in writing in an agreement.

2. Many divorces process amicably through mediation. Hiring a third party to facilitate negotiations has a very high success rate.

If mediation works, the mediator can draft up an agreement for signing.

3. Each spouse hires an attorney but each instructs the attorney to focus on negotiation.

4. The parties agree to hire a former judge or another lawyer to preside over a mini-trial. This is like arbitration where a decision is made.

This is good because you can get a mini-trial fast and it’s cheaper than a full-blown trial. You can do it with or without a lawyer.

5. Still no resolution? Put on the trial gloves and go let a court decide. When this happens you no longer have any control in the outcome.

There are many steps in getting through divorce you can take without hiring a lawyer or going down the ugly litigation route.
